TBI Agents Investigating Nashville Shooting

January 5, 2023 – At the request of 20th Judicial District Attorney General Glenn Funk, TBI special agents continue to investigate the circumstances leading to the Thursday afternoon deadly shooting of a man by officers from the Metropolitan Nashville Police Department.

Preliminary information indicates the incident occurred at approximately 2:00 p.m. at a home in the 100 block of Summit Run Place in Hermitage. Officers responded to the location to arrest the home’s owner, identified as Mark Capps (DOB 12-14-68), on warrants charging him with two counts of Aggravated Assault and two counts of Kidnapping, related to an incident involving family members. When officers arrived, they attempted to contact Capps, who came to the door of his home holding a pistol. Officers ordered Capps to show his hands, but the situation escalated further, resulting in one officer firing his service weapon, killing Capps. No law enforcement officers were hurt in the incident.

TBI agents are working to independently determine the series of events leading to the shooting, including collecting evidence and conducting interviews.  Throughout the process, investigative findings will be shared with the district attorney general for his further review and consideration.  The TBI acts solely as fact-finders in its cases and does not determine whether the actions of an officer were justified in these types of matters.  That decision rests with the district attorney general requesting TBI’s involvement.

The TBI does not identify the officers involved in these types of incidents and instead refers questions of that nature to the respective department to answer as it sees fit.
